These Terms of Service (“Terms”) govern your access to and use of the website securitywarehouseaust.online (the “Website”) and any goods or services supplied by Security Warehouse (Aust) Pty Ltd through the Website or by other means. By browsing the Website, requesting a quotation, placing an order or otherwise using our goods or services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Website or our services.
1. About Us
Security Warehouse (Aust) Pty Ltd (ABN 81 702 572 254) (“we”, “us”, “our”) is an Australian company based in Melbourne VIC that supplies security systems, alarms and surveillance equipment to residential, commercial and industrial customers across greater Victoria and, by arrangement, elsewhere in Australia. References in these Terms to “you” mean any individual or entity that uses the Website or purchases goods or services from us.
2. Quotations and Orders
Unless otherwise stated in writing, quotations provided by us are valid for thirty (30) days from the date of issue and are based on the specifications, quantities and site details supplied by you at the time of the request. Quotations may be revised if those details change materially or if equipment becomes unavailable. An order is accepted only when we confirm it in writing (including by email) or dispatch the goods. We may decline or cancel an order, in whole or in part, where stock is unavailable, pricing has been misquoted in error, or the order appears fraudulent. Where we cancel an order after payment has been made for undelivered goods, we will refund the relevant amount.
3. Prices, GST and Payment
All prices are quoted in Australian dollars (AUD). Prices for goods sold to Australian consumers include goods and services tax (GST) where applicable. Payment must be made by the method and within the timeframe stated on our invoice or quotation. Where payment terms are granted to approved business customers, we may suspend further supply and charge reasonable administration costs on overdue accounts. You are responsible for any duties, taxes or charges applicable in your jurisdiction.
4. Delivery, Risk and Title
Any delivery date or timeframe we provide is an estimate only and is not guaranteed. Risk of loss or damage to goods passes to you upon delivery to the delivery address you nominate or upon collection from our premises. Legal and equitable title to goods passes to you only when we have received payment in full for those goods. You must inspect goods on delivery and notify us of any shortage, damage or incorrect item within a reasonable period, and in any case within seven (7) days of delivery.
5. Consumer Guarantees under the Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot lawfully be excluded, restricted or modified.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage caused by our breach of a consumer guarantee. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
6. Returns, Refunds and Manufacturer Warranties
If you believe goods supplied by us fail to meet a consumer guarantee, please contact us by email with your order details, a description of the issue and, where relevant, photographs. We will assess your claim in accordance with the Australian Consumer Law and, where a remedy is required, provide a replacement, repair or refund as appropriate to the circumstances.
Many products we supply also carry a manufacturer’s warranty. Where a manufacturer’s warranty applies, we can assist you in lodging a warranty claim with the manufacturer or its authorised service agent, or you may deal with the manufacturer directly. Manufacturer warranties are additional to, and do not limit or replace, the consumer guarantees under the Australian Consumer Law.
Returns of goods that are not faulty and are returned simply because you have changed your mind may be accepted at our discretion, provided the goods are unused, in their original packaging and in resalable condition. Any freight or handling costs for discretionary returns may be borne by you.
7. Installation and Use of Equipment
Unless expressly agreed in writing, we supply equipment only and are not engaged to install it. Installation of security systems, alarms, CCTV and associated cabling must be carried out by suitably qualified and, where required by law, licensed persons in accordance with the manufacturer’s instructions and applicable Australian Standards. You are responsible for selecting an appropriate installer, for compliance with any strata, body corporate, landlord or regulatory requirements relevant to your premises, and for ensuring that surveillance equipment is not used in a manner that would contravene the Surveillance Devices Act 1999 (Vic), the Privacy Act 1988 (Cth) or any other applicable law.
8. Website Content and Intellectual Property
All content on the Website, including text, product descriptions, images, logos and layout, is owned by or licensed to Security Warehouse (Aust) Pty Ltd and is protected by Australian and international copyright and trade mark laws. You may view, download and print material from the Website for your own personal or internal business use. You must not reproduce, republish, transmit or exploit any Website content for commercial purposes without our prior written consent, and you must not use the Website in any way that is unlawful, fraudulent or harmful, or that interferes with the operation of the Website.
Product specifications, images and descriptions are provided for general information only and are subject to change by manufacturers. While we take reasonable care to ensure the accuracy of Website content, we make no representation or warranty as to its completeness or suitability for your particular purposes, except as required by the Australian Consumer Law or other applicable law.
9. Limitation of Liability
To the maximum extent permitted by law, we are not liable to you for any indirect, incidental, special or consequential loss or damage, including loss of profits, loss of revenue, loss of data or loss of business opportunity, arising from your use of the Website or our goods or services. Where the Australian Consumer Law or any other law guarantees conditions or warranties that cannot be excluded, our liability for breach of such a guarantee is limited, to the extent permitted by law, to the remedies described in section 5 of these Terms. Nothing in this section limits or excludes your rights under the Australian Consumer Law.
10. Privacy
We handle personal information in accordance with our Privacy Policy. By using the Website or our services, you consent to the collection, use and disclosure of personal information as described in that policy.
11. Links to Other Websites
The Website may contain links to third-party websites, including manufacturer and product pages. Those links are provided for convenience only. We do not control, endorse or accept responsibility for the content, policies or practices of any third-party website, and your dealings with any third party are solely between you and that third party.
12. Governing Law
These Terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts competent to determine disputes under the Australian Consumer Law.
13. Changes to These Terms
We may amend these Terms from time to time by publishing an updated version on this page. The version published on this page at the time you place an order or request a quotation applies to that transaction. Your continued use of the Website after an updated version is published constitutes acceptance of the updated Terms.
